Abstract

This study examines the impact of Artificial Intelligence (AI) on the development of waqf legislation and waqf management mechanisms through the integration of intelligent technologies and financial technology (FinTech) to enhance digital governance, transparency, and the efficiency of investing waqf assets, while ensuring compliance with Sharia principles and the objectives of waqf (Maqasid al-Waqf). The study addresses the central question of the extent to which AI can contribute to modernizing the waqf system and the possibility of establishing a smart waqf model that achieves a balance between technological efficiency and Sharia compliance. It adopts a descriptive, analytical, and comparative methodology, analyzing major digital applications, particularly big data, blockchain technology, and smart contracts. The study also examines the experiences of the Saudi Ehsan Platform and the Malaysian Finterra platform as two leading models of smart waqf. The findings indicate that AI represents a strategic approach to enhancing the efficiency, transparency, and sustainability of waqf management. However, the success of this digital transformation depends on the existence of a flexible legislative framework, effective digital governance, and robust Sharia supervision to ensure the realization of the objectives of waqf.
